- Customers are responsible for notifying Sparks Trucking of fragile surfaces, septic systems, culverts, drainage structures, private utilities, irrigation, wells, underground features, soft ground, low-clearance areas, unstable routes, or other site hazards.
- Customers are responsible for securing pets, livestock, children, visitors, employees, tenants, subcontractors, and other persons from active truck, delivery, hauling, or equipment areas.
- Customers are responsible for obtaining any required owner approvals, permits, easements, access permissions, road-use permissions, or community approvals connected to their project.
Sparks Trucking may rely on the customer’s directions regarding where to enter, travel, unload, stage, turn around, or perform requested work. The customer accepts responsibility for giving access instructions and identifying conditions that could affect property, vehicles, equipment, or safety.
Hidden conditions must be identified before work begins.
Customers are responsible for identifying and disclosing known or suspected underground utilities, private lines, irrigation systems, drainage pipes, septic systems, wells, culverts, electrical lines, fiber, gas lines, water lines, property markers, and other hidden conditions in or near proposed work, travel, delivery, or unloading areas.
Sparks Trucking does not guarantee discovery of hidden, unmarked, privately installed, inaccurately marked, or undisclosed underground conditions. Customers should arrange for appropriate utility-location or site-review services when needed before excavation, grading, material placement, access work, or equipment activity begins.
Material delivery and trucking are performed around safe, accessible project conditions.
Material quantities, delivery location, route, unloading method, truck configuration, and timing are determined by Sparks Trucking based on the accepted project scope, available equipment, legal requirements, jobsite conditions, safety considerations, and operational judgment.
- Material loads may vary by material type, moisture, compaction, supplier, scale weight, truck capacity, and jobsite delivery conditions.
- Customers are responsible for having a safe, accessible, and reasonably suitable delivery route and unload area for the requested truck or equipment.
- Sparks Trucking may refuse travel, unloading, backing, dumping, access, or placement when conditions appear unsafe, unstable, unlawful, inaccessible, or likely to create avoidable risk.
- Customers are responsible for spreading, finish grading, compaction, drainage, engineering, testing, and final project performance unless those services are specifically included in a written agreement.
Operations are subject to applicable safety, transportation, and roadway requirements.
Sparks Trucking operates subject to applicable federal, state, and local laws, roadway requirements, transportation rules, safety requirements, permit requirements, and lawful operating limits. Nothing in these Terms requires Sparks Trucking to perform work, travel a route, exceed limits, enter property, deliver materials, or operate equipment in a manner that conflicts with safety or legal requirements.
Customers must cooperate with reasonable safety instructions, access restrictions, delivery timing, route limitations, site-control requirements, and field decisions made to protect people, property, equipment, and lawful operations.
Insurance coverage is governed by actual policies and certificates.
Sparks Trucking maintains insurance coverage appropriate to its operations; however, coverage, limits, exclusions, endorsements, deductibles, certificates, and current policy status are governed only by the actual insurance policy documents and any valid certificate of insurance issued by the insurer or authorized agent.

To the maximum extent permitted by applicable law, Sparks Trucking is not liable for indirect, incidental, special, consequential, exemplary, punitive, or business-related damages, including lost profits, lost use, delay, business interruption, project delay, loss of opportunity, or damages arising from inaccurate information provided by a customer or third party.
Sparks Trucking is not responsible for conditions outside its control, including weather, utility interruptions, supplier delays, route closures, government actions, undisclosed site conditions, inaccessible property, unstable ground, inaccurate directions, third-party actions, unsafe conditions, or events beyond reasonable operational control.
